1. Introduction

These Terms and Conditions ("Terms") govern your use of the website at somorinestatesltd.com and the services provided by Somorin Estates Limited ("we", "us", "our"), a company registered in Jamaica (registered address: 58 Outlook Avenue, Mount Dawson, St. Catherine, Jamaica).

By accessing our website, submitting an enquiry, booking a Strategy Session, or purchasing any product or service from us, you agree to be bound by these Terms. Please read them carefully before proceeding.

2. About Our Services

Somorin Estates Limited is a property and diaspora return consultancy providing structured guidance, advisory services, and planning resources to members of the Jamaican diaspora in the UK, USA, and worldwide who are planning to relocate, build, or invest in Jamaica.

Our services include:

Strategy Sessions — one-to-one paid consultations delivered via Zoom, booked through our Strategy Session application process
The Relocation Guide — a downloadable digital guide available for purchase
Return Planning and Design & Build advisory services — available to clients following an initial Strategy Session

We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice.

3. Strategy Session Application and Booking

3.1 Application Process

Strategy Sessions are available by application only. Submitting an application does not guarantee a booking. We review all applications and will contact you to confirm eligibility and arrange scheduling.

3.2 Booking Confirmation

A booking is confirmed only once payment has been received in full and a confirmation has been sent to you by email. We reserve the right to decline any application without obligation to provide a reason.

3.3 Session Fee

The Strategy Session fee is £125 (GBP). Payment is processed securely via Stripe at the time of booking. All prices are inclusive of any applicable taxes unless otherwise stated.

3.4 Session Delivery

Strategy Sessions are delivered via Zoom. You are responsible for ensuring you have a stable internet connection and access to Zoom prior to your session. We are not liable for technical difficulties on your end that affect the quality or completion of the session.

4. Payment Terms

All payments are processed through Stripe, a third-party payment processor. By making a payment, you also agree to Stripe's terms of service, available at stripe.com/legal.

Payment is due in full at the time of booking. We do not offer instalment plans for individual Strategy Sessions unless separately agreed in writing.

All transactions are conducted in GBP (British Pounds Sterling). If you are paying in a different currency, your bank or card provider may apply a conversion fee. We are not responsible for any such charges.

5. Cancellation and Rescheduling Policy

5.1 Rescheduling

Sessions may be rescheduled by you with a minimum of 24 hours' notice prior to the scheduled session time. To reschedule, please contact us at consult@somorinestatesltd.com. Rescheduling requests made with less than 24 hours' notice may not be accommodated and the session fee may be forfeited.

5.2 Non-Refundable Fee

The Strategy Session fee of £125 is non-refundable in all circumstances, including where you are unable to attend, reschedule with less than 24 hours' notice, or choose not to proceed with further services.

5.3 Deductible Credit

Notwithstanding the above, the Strategy Session fee of £125 is deductible from a formally signed development engagement entered into within 60 days of the Strategy Session date. This credit applies only to directly contracted services with Somorin Estates Limited and cannot be transferred, exchanged, or applied to third-party costs.

5.4 Cancellation by Us

In the unlikely event that we need to cancel a session, we will contact you as soon as possible and offer a full refund or a rescheduled session at your preference. We are not liable for any further costs or losses arising from such cancellation.

By completing a booking, you confirm that you have read and accepted this cancellation and rescheduling policy.

6. Digital Products — The Relocation Guide

6.1 Purchase and Delivery

The Relocation Guide is a downloadable digital product priced at £47 (GBP). Upon successful payment, you will receive a download link by email. Please check your spam or junk folder if you do not receive this within a few minutes of purchase.

6.2 No Refunds on Digital Products

Due to the nature of digital downloads, the Relocation Guide is non-refundable once the download link has been accessed or the file has been downloaded. If you experience a technical issue preventing download, please contact us at consult@somorinestatesltd.com and we will assist you.

6.3 Personal Use Only

The Relocation Guide is licensed for your personal use only. You may not reproduce, distribute, sell, share, or republish the guide or any part of it without our express written permission.

7. Intellectual Property

All content on somorinestatesltd.com, including but not limited to text, images, graphics, guides, templates, and branding, is the intellectual property of Somorin Estates Limited and is protected by applicable copyright and intellectual property laws.

You may not copy, reproduce, republish, distribute, or use any of our content for commercial purposes without our prior written consent. You may share links to our website and reference our publicly available content for personal, non-commercial purposes, provided appropriate credit is given.

8. Disclaimer of Liability

8.1 Nature of Our Services

The information and advice provided through our services, including Strategy Sessions, the Relocation Guide, and all website content, is intended for general guidance purposes only. It does not constitute legal, financial, architectural, or regulatory advice.

8.2 No Guarantees

We make no guarantees regarding the outcome of any planning application, development project, relocation process, or property transaction that you may undertake following engagement with our services. Results will depend on your individual circumstances, the actions of third parties, and factors outside our control.

8.3 Limitation of Liability

To the fullest extent permitted by applicable law, Somorin Estates Limited shall not be liable for any indirect, incidental, consequential, or special damages arising out of or in connection with your use of our services or website, including but not limited to loss of profit, loss of data, or costs incurred as a result of acting on our guidance.

Our total liability to you in connection with any single engagement shall not exceed the amount paid by you for that specific service.

8.4 Third Party Services

Our website and booking process involve third-party services including Wix (website platform), Calendly (scheduling), Stripe (payments), and Zoom (video consultations). We are not responsible for the performance, availability, or conduct of these third-party platforms.

9. Website Use

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others. We reserve the right to restrict or terminate access to our website at our discretion.

We make reasonable efforts to ensure the website is available and accurate but we do not guarantee that it will be free from errors, interruptions, or security vulnerabilities.

10. Privacy

Your use of our website and services is also governed by our Privacy Policy, available at somorinestatesltd.com/privacy-policy. By using our services, you confirm that you have read and understood our Privacy Policy.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Jamaica as the primary jurisdiction, given that Somorin Estates Limited is a company registered in Jamaica.

Where you are a consumer resident in the United Kingdom, you retain the benefit of any mandatory consumer protection rights afforded to you under English law, and nothing in these Terms shall operate to remove or restrict those rights.

Any disputes arising in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of Jamaica, except where mandatory English law provisions apply to UK-based consumers.

We reserve the right to update these Terms at any time. The most current version will always be published on this page with an updated "Last updated" date. Your continued use of our services following any changes constitutes your acceptance of the revised Terms.
